1. Acceptance of Terms
By accessing or using AISend ("the Service"), you agree to be bound by these Terms of Service. If you do not agree, do not use the Service. These terms apply to all users, including API consumers and dashboard users.
2. Description of Service
AISend provides an AI-powered email API platform for sending transactional emails. The Service includes a REST API, dashboard, webhooks, domain management, and AI-powered deliverability optimization.
3. Account Registration
You must provide accurate information when creating an account. You are responsible for maintaining the security of your account credentials and API keys. You must notify us immediately of any unauthorized access.
4. Acceptable Use
You agree not to use the Service to send spam, phishing emails, or any unsolicited bulk email. You must comply with all applicable anti-spam laws (CAN-SPAM, GDPR, etc.). You must not use the Service to send malicious content, malware, or engage in any illegal activity. We reserve the right to suspend accounts that violate these policies.
5. API Usage & Rate Limits
Each plan has email sending limits. Exceeding your plan limits may result in additional charges or throttling. API rate limits apply to prevent abuse. You must not attempt to circumvent rate limits or abuse the API.
6. Payment & Billing
Paid plans are billed monthly or annually. Prices are in USD. You authorize us to charge your payment method for recurring fees. Refunds are handled on a case-by-case basis. We may change pricing with 30 days notice.
7. Service Level Agreement
We strive for high availability. Paid plans include uptime SLAs as described on our pricing page. The free tier is provided as-is without uptime guarantees.
8. Limitation of Liability
The Service is provided "as is" without warranty of any kind. We are not liable for any indirect, incidental, or consequential damages arising from your use of the Service. Our total liability is limited to the amount you paid us in the 12 months preceding the claim.
9. Termination
Either party may terminate the agreement at any time. You can delete your account from the dashboard settings. We may suspend or terminate accounts that violate these terms. Upon termination, your data will be deleted according to our privacy policy.
10. Changes to Terms
We may update these terms from time to time. Continued use of the Service after changes constitutes acceptance. We will notify you of material changes via email.
